GreenShpits Facebook App Privacy Policy
1. Introduction
All of GreenShpits’s Facebook App’s, including this one, are operated and run by Network GreenShpits Pty Limited (Reg# 514599232) of Akiva 90, Raanana, Israel1 (‘GreenShpits’, ‘us’ or ‘we’).
The terms of this Facebook App Privacy Policy, apply to content which you may provide to GreenShpits during your use and interaction with GreenShpits’s Facebook Apps.
You are deemed to have accepted the terms of those policies once you install the relevant GreenShpits Facebook App. If you do not agree with any of the terms in the policies, please do not install the relevant GreenShpits Facebook App.
As a registered Facebook user, you are subject to Facebook’s privacy policy as well as other relevant user terms and conditions. Please make sure you are familiar with all relevant terms and conditions which apply to you as a user of Facebook.
If there is a conflict between the GreenShpits Facebook App’s Privacy Policy and Facebook’s terms and conditions, guidelines and privacy policies then as between you and us, GreenShpits’s Facebook App’s Privacy Policy (this document) will prevail.
2. What information does GreenShpits collect?
A. Facebook Data
 
When you log into a GreenShpits App for the first time, it may (depending on the type of App
that it is), ask you for permission to access some of your Facebook Profile information
for example, it may ask permission to have access to your:
(a) Basic Information (which includes your name, profile pictures, user name,
and other information forming your Basic Account Information on
Facebook);
(b) Profile Information (including your birthday, groups, hometown, likes, and
location etc.); and
(c) your photos.
We call this information ‘Facebook Data’. This is called Facebook data because it is data that is supplied by you to Facebook and then by Facebook to GreenShpits.
If you decide not to grant permission to the relevant GreenShpits Facebook App to have access to your Facebook Data, you may not be able to use that GreenShpits Facebook App.
B. IndependentData
During your interaction with our Apps, you may also independently provide us with
information about yourself, for example, if you enter a competition or fill out a form
through a functionality provided within the App itself.
We call this data ‘Independent Data’ because it is data that you have given to GreenShpits
through the App. By providing us with this data you acknowledge that it is data that
we may use and store in accordance with this privacy policy and any other legal
requirements that may apply (for example, if you enter a competition, we need to
hold your data to ensure that if you win, we can contact you).
3. Why do we need information from you?
We need information from you so that we can:
. (a)  personalise the content of our Facebook App’s to suit individual users; and
. (b)  monitor, administer and improve the functionality of our App’s including the running of competitions and promotions which may be of interest to you; and
. (c)  advertise on our Facebook App’s; and
. (d)  with your consent, send marketing emails to you from us and our approved third parties (where you have given such consent). It will be clear to you when you are providing this consent because you will have to tick a box and specifically agree to opt-in to receive such materials. Please refer to our FAQ’s for further information on how to manage your GreenShpits profile.

4. How do we use your Facebook Data and your Independent
Data?
(a) We will collect and use your Facebook Data and your Independent Data
only where we are legally entitled to do so, in accordance with our
privacy policy, this Facebook Apps Privacy Policy, and in the case of your
Independent Data, where and how you have consented to us using that
data.
(b) We may share your Independent Data that you have given to us with
other companies within our group, our associates and affiliates (refer to
clauses (e) and (f) below).
(c) We may disclose your Facebook Data and your Independent Data to comply with any applicable law, regulation, legal process or government request.
. (d)  We also reserve the right to transfer your Facebook Data and your Independent Data in the event that we sell or transfer all or a portion of our business or assets. Should such a sale or transfer occur, we will use reasonable efforts to direct the transferee to use your Facebook Data and your Independent Data in a manner that is consistent with this Facebook Apps Privacy Policy. Following such a sale or transfer, you may contact the entity to which we transferred your Facebook Data and your Independent Data with any inquiries concerning the processing of that information.
. (e)  We may perform statistical analysis on user activity within our Facebook Apps so that we can measure the level of interest in, and varied use of the different functions contained in them. We may inform third parties of the results of such statistical analysis in aggregate form, for example, ‘300,000, 16 to 39 year olds visited our App today’.
. (f)  In the event that you have participated in a competition we may share your data with a third party contracted to perform a random operated draw enabling the selection of a winner or winners. We may also share the data of the winner/s details with the relevant associated client or prize sponsor who requires the information for the purpose of fulfilling the prize.
. (g)  In the event that the data collected for the competition is hosted by a third party, GreenShpits may have access to this data or your data will be shared with GreenShpits for the purpose of winner judging or for distribution to a third party to conduct a random operated winner draw.
5. How We Protect Your User Information
. (a)  We have internal security measures in place to help protect personal data given to GreenShpits from misuse, modification, unauthorised access, or disclosure. We have a security system in place to deal with the physical security of our premises and the personal information kept at our premises. We have procedures in place to maintain a secure computer/ electronic system. We take reasonable steps to ensure that work areas are secure, and information on databases is protected by pass words and accessed only for legitimate purposes. Relevant staff are made aware of their obligations under the Australian National Privacy Principles to make your privacy a priority in dealing with personal information.
. (b)  We take reasonable steps to ensure the information we collect, use and disclose is accurate, complete and up to date.
. (c)  If we have contracted out a service to a third party, we may need to disclose your personal information to that third party to ensure that you get the service needed. In these circumstances, we require the third party to protect the privacy of the information that is disclosed to it.
. (d)  When we no longer need your personal information we have procedures in place to either destroy it in a secure manner or to permanently de- identify the information. Also you can contact us below to request that we delete your Facebook Data, and/or Independent Data.
. (e)  While we cannot guarantee that no accidental, unlawful or unauthorized destruction, loss, alteration, access, disclosure or use of your information will occur, however we will work hard to prevent any such occurrences.
 
6. Copyright and jurisdiction
(a) You are permitted to visit and use GreenShpits’s Facebook App’s and any content
created by those App’s solely for your own personal non-commercial use.
Any copying, reproduction or any other form of distribution of content
contained within GreenShpits’s Facebook App’s other than in accordance with
this GreenShpits Facebook App’s Privacy Policy or any other terms and conditions
(for example the terms and conditions associated with a specific
competition being run through the App’s), by you or any third party is
prohibited and will constitute a copyright infringement.
(b) The GreenShpits Facebook App’s Privacy Policy (and any matter or dispute of
whatever nature connected to the Tens Facebook App’s Privacy Policy) is
governed by and will be construed in accordance with the laws of New
South Wales, Australia and the courts of New South Wales have exclusive
jurisdiction to hear such disputes.
7. How to delete a GreenShpits Facebook App
. (a)  You may stop GreenShpits from having access to your Facebook Data at any time by
. (i)  uninstalling the Facebook Application and setting your Facebook privacy settings to prevent the relevant GreenShpits Facebook App from accessing your Facebook Data; 
or
. (ii)  deleting your Facebook account.
. (b)  Following your de-installation of the relevant GreenShpits Facebook App or deletion of your Facebook account, certain elements of your Independent Data may still be preserved in a non-personally identifiable form as part of aggregate historical data reports used by GreenShpits.
. (c)  Subject to applicable law, we provide you with access to the information we have retained about you and the ability to review, correct, update, block or delete the information where it is inaccurate. Please submit your request to the address specified in the Contact Us section.

8. How to Contact Us
. (a)  We maintain records of Independent Data your have provided to us through your interaction with our Facebook Apps and our websites. You can gain access to the personal information held by GreenShpits about you in two ways. If you have registered through this App to become a member of any of GreenShpits’s websites, most information held by GreenShpits about you can be viewed and changed directly by you by logging into those sites using your username and password and reviewing your preferences. Except in some limited circumstances such as where the information is commercially sensitive, any other information held by GreenShpits about you is available by contacting GreenShpits.
. (b)  If you inform us that the information we hold is incorrect we will, if appropriate, amend those records.
